1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Kliptra Inc. ("we," "us" or "our"), concerning your access to and use of the Kliptra web application, iOS application, and website at https://kliptra.com (collectively, the "Services"). By using our Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Description of Service
Kliptra provides software tools for recording, editing, and exporting screen captures and video content. We constantly evolve our product; therefore, the form and nature of our Services may change without prior notice to you.
3. User Accounts
To use certain features, you must register for an account (e.g., via Google Authentication). You agree to:
- Provide accurate, current, and complete information.
- Maintain the security of your password and accept all risks of unauthorized access.
- Immediately notify us if you discover or suspect any security breaches related to the Services.
4. Subscriptions and Payments
Kliptra offers free and premium tiers. Our premium plans are billed on a subscription basis (e.g., $4.99 Monthly or $39.99 Yearly).
- Billing Cycle: You will be billed in advance on a recurring, periodic basis (monthly or annually) depending on the subscription plan you select.
- Auto-Renewal: Unless you cancel your subscription before the end of the current billing cycle, your subscription will automatically renew.
- Cancellation: You may cancel your subscription renewal at any time via your account settings. You will continue to have access to the premium features through the end of your current billing period.
- Refunds: Except when required by law, paid subscription fees are non-refundable.
5. User Content and License
You retain all ownership rights to the videos, screen recordings, audio, and images you create or upload using Kliptra ("User Content").
By saving your User Content to our cloud services, you grant us a limited, worldwide, non-exclusive license to host, store, and process your content solely for the purpose of operating and providing the Services to you. We will never use your User Content for marketing purposes or share it publicly without your explicit, separate approval.
6. Acceptable Use Policy
You agree not to use the Services to:
- Record or distribute content that is illegal, defamatory, highly offensive, or violates the privacy rights of others.
- Reverse engineer, decompile, or disassemble any aspect of the Services.
- Attempt to bypass or circumvent any security or usage limits enforced by the Services.
- Use the Services to transmit malware, viruses, or malicious code.
We reserve the right to suspend or terminate your account if you violate this policy.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KLIPTRA INC., ITS DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOST BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date and posting a notice in the app. Your continued use of the Services following the posting of changes constitutes your acceptance of such changes.
